MegaSniper website, service and software are provided only for your personal, non-commercial use by Mediacom. This site and any portion hereof may not be reproduced, duplicated, copied, downloaded, sold, resold, visited, or otherwise exploited for any commercial purpose. If you want to make commercial use of the MegaSniper Site and software, you must enter into a written agreement with us.

You are required to specify unique user ID and Password, that represent who you are in the Site.  You allow MegaSniper to use that information to bid for you. If you become aware that that your ID is being used by others you agree to contact MegaSniper immediately. You are responsible and liable for all activities conducted through your user ID and password, even if this occurs without your permission.

After using all your promotional free bids provided to new users, you have to procure MegaSniper Pre-Paid Winning Bids to be able to further submit your bids. You may always check the fees and procure the MegaSniper Winning Bids on the relevant part of the website MegaSniper.com. We reserve the right to alter all fees at any time, without notice. MegaSniper Pre-Paid Bids are non-refundable.

You can add as many auctions as you like to your MegaSniper account at one time. If you win more auctions than you have left on your account we’ll simply credit any extra winning bids to your next bids purchase. To receive credit for extra winning bids your next purchase of 10 or more MegaSniper Winning Bids^SM will need to be made within 30 days of your last successful auction.

Because a range of factors including, but not limited to—server disconnections, network interruptions, network slow downs, hacker interference, your inability to contact MegaSniper, changes to the online auction website that impact our software can interfere with the correct submission of your bid. MegaSniper does not guarantee the submission of your bid. We disclaim all liability for bids requested but not placed.

Furthermore, by using MegaSniper you have agreed not to attempt to gain unauthorized access to any services of the Site, other accounts, computer systems or networks connected to any MegaSniper servers, through hacking, password mining or any other means.

You may not obtain or attempt to obtain any materials or information related to MegaSniper or its services through any means not intentionally made available through MegaSniper.com or Mediacom.

Electronic communications

By visiting MegaSniper.com or sending us e-mail, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.
You may use the Site to purchase products, services or software from MegaSnipers's third party partners. In that event, your contract for such products will be with the third party partner and not with MegaSniper.

Limitation of Liability

IN NO EVENT SHALL WE, OUR PARENT, SUBSIDIARIES, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR WEB SITE, OUR SERVICE, OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). Some states do not allow the exclusion or limitation of incidental or consequential damages so the above limitation or exclusion may not apply to you.

OUR LIABILITY, AND THE LIABILITY OF OUR PARENT, SUBSIDIARIES, EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE ACTUAL AMOUNT OF DIRECT DAMAGES.

Indemnification
